The 9th US Circuit Court of Appeals unanimously ruled on Thursday that the suspension of US President Donald Trump’s executive order barring entry to nationals of seven Muslim-majority countries should remain in place, after hearing the cases of the states of Minnesota and Washington against the ban and arguments in support of it by the Department of Justice.
继听取明尼苏达州、华盛顿州与美国司法部的口头辩论后,周四,美国第九巡回上诉法院统一裁定继续暂停美国总统特朗普限制七国穆斯林入境的行政命令。
The appeals court said the US government had not offered “any evidence” of national security concerns to justify the ban, which has created confusion in airports around the world.

Trump however tweeted in reaction to the court’s decision: “See you in court, the security of our nation is at stake!”

The next step for the Department of Justice is likely to be another appeal, but this time to the Supreme Court. The lower court of appeal had heard from the Department that President Trump had the constitutional power to bar entry to nationals from seven Muslim-majority countries to safeguard the security of the country against a terrorist threat.

This argument was countered by lawyers representing the two states of Minnesota and Washington, who argued that the ban affected individuals, families and universities, and cited Trump’s presidential campaign pledge to enforce a Muslim ban to plead the case that the executive order was based on religion, and therefore unconstitutional.
